Five models, no longer one
Decree 23-429 annexed a single form, built around a preliminary question: is the beneficial owner among the persons already named in the registration application? Depending on the answer, you filled one side or the other. Decree 26-163 drops that mechanism and replaces it with five separate models, one per type of entity, all of which start directly with the entity's details, then the declarant's, then the beneficial owner's.
The difference is not cosmetic. The commercial companies model is the only one that asks whether the beneficial owner is a direct or indirect shareholder. The wakf model asks for an identification number for the wakf property and for the declarant's capacity among Nadher, constituent or custodian. The legal arrangements model requires the identity of the settlor, the trustees, the custodian and the protector, plus three separate addresses. Using the wrong model means leaving mandatory sections blank.
What the form now asks of the declarant
This is the other quiet change of 2026. Where the old form made do with an “identification of the declaring person”, the new one requires a full identity, with national identification number, identity card number with place and dates of issue and expiry, or passport number for foreign nationals, phone, email, and capacity within the entity. The declarant is no longer an anonymous signatory: they are identified as precisely as the beneficial owner, and article 8 of the decree requires their name, first name, signature and capacity.
A foreign declarant fills in the passport and leaves the NIN blank; the reverse for an Algerian resident. The tool leaves unfilled lines dotted, as on the official form, and they can be completed by hand at the counter.
Several beneficial owners: as many forms
Article 10 is explicit: where there are several beneficial owners, a separate declaration form must be provided for each. The form itself asks the question at the foot of the page, “is there another beneficial owner than the one declared in this document?”, and points to a separate copy for each. The 20 % threshold opens the search but does not close it: article 15 states that natural persons exercising ultimate control must be identified as beneficial owners whether or not they hold a stake above that threshold.
What the form does not settle
The printed document is the declaration. It replaces neither the internal ad hoc register that article 17 requires to be kept accurate and up to date, nor the update within thirty days of any change, nor the annual confirmation before 31 December. And where the ownership chain runs through one or more legal persons, foreign ones above all, article 8 requires the additional documents needed to establish the ownership and control chain.
